What is IPC Section 420

 

Section 420 of the Indian penal code states that anyone who cheats or thereby deceives another person to deliver any property or make, alter, destroy any valuable security or anything which is signed, sealed and capable of being made into a valuable security shall be sentenced with either imprisonment or a fine.

 

Section 420: Essential elements

 

Cheating

 

Inducing someone to sell property, to make, alter, or destroy valuable security or any item that is sealed or can be converted into a valuable security is dishonest.

Mens rea for the accused during the instigation.

 

Section 415 of Indian Penal Code defines cheating. Every offense under Section 420 of the I.P.C. must contain cheating.

 

Section 415 of the IPC says that anyone who deceives any person to deliver any property or consent to the retention of any property by any person or in any other way induces that person to do or not do something he would not do if he weren't so deceived is called "cheat".

 

Two people A and Z are an example. Z is made to believe that the fake sample of the article A has shown Z is the real one. Z is induced by A to purchase and pay for the fake article sample. Z is cheated by A.

 

Acting dishonestly

 

Section 24 defines what constitutes "acting dishonestly". If any act, or the inability to do any act, causes the wrongful gain or loss of property for one person, it is dishonest.

 

Property

Fraudulently

 

Section 25 defines "fraudulently". Section 25 defines fraudulently as a person who does something fraudulently with the intent to defraud.

 

Mens rea

 

Mens rea refers to a legal term that describes the mental state of someone who is committing a crime. It should not be accidental. It could refer to either a general intention to violate the law or a prearranged plan to do so. To convict an accused, a criminal prosecutor must prove beyond reasonable doubt that the suspect actively and knowingly participated in a crime that adversely affected another person or their property.

 

Section 420 Penalty

 

Section 420 IPC provides for the punishment of imprisonment for up to seven years and a fine.
